Here are highlights from West Virginia law on operating under the influence of alcohol;

'Per Se' blood alcohol content level is .08.  Zero tolerance law requires anyone age 21 years and younger must have a blood alcohol level of no more then .02.  Under the implied consent law if suspected of DUI you are to submit to breath, blood or urine sample.  Possible ignition interlock may be part of your penalty.  A machine connected to your cars ignition that senses alcohol on the driver.  The driver must blow into the device in order to start and keep the car in motion. The offender is also responsible for the cost of the installation and maintenance of the device.  After second offense mandatory jail time is given.  It is possible that the offender will be mandated to participate in alcohol education program.  An assessment is also done to evaluate the offenders drinking level and if found dependent on alcohol then treatment would follow.

License Suspension 1st Offense: 6 months
License Suspension 2nd Offense: 1 year
License Suspension 3rd Offense: 1 year

Hardship license while license is still under suspension can be granted after 30 days if proven special hardship, such as being the sole provider of your family.
