Below is a summary from Texas law on driving while intoxicated;

 

Zero tolerance law for people age 21 years and younger must have a blood alcohol content of .00.  Everyone else must have no more than a BAC level of .08.  License suspension on 1st offense is for 90 days and second and third offense is for 180 days.  Implied consent law command you to submit to blood, breath or urine sample if suspected of DUI.  Mandatory jail time after second offense and possible vehicle confiscation after third offense.  Possible Ignition Interlock, a device hooked to the cars ignition that detects alcohol.  The offender is responsible for the cost of the installation and maintenance of the device.  Open container law if for driver and passengers.  An enhanced penalty can be given to those with a blood alcohol content level of .15, speeding over a certain limit, driving with minors in the car, previous convictions and refusal to take breath, blood or urine sample.
