These are highlights of the main provisions of South Dakota law pertaining to drunk driving;

'Per Se' blood alcohol content level is .08.  Zero tolerance law make it illegal for persons under age 21 to drive with any amount of alcohol in their system. These laws penalize persons under 21 for operating a vehicle with a BAC of .02 in the state of South Dakota.  Enhanced penalties for drunk driving in South Dakota are increased depending on several factors, including a blood alcohol content over .17, driving over a certain speed, having minors in the car, refusing to take a chemical test, having a traffic accident, or having prior convictions.  Open container law prohibits the possession and drinking from an open alcoholic beverage container from inside a vehicle or in public places.  This is for both driver and passengers in the state of South Dakota. Implied consent law require vehicle drivers to submit to a chemical test - breath, blood or urine testing, if they are suspected of DUI. If the driver refuses to submit to the test, implied consent laws carry penalties such as mandatory suspension of a driver's license.
