Here are highlights from New York law on operating a vehicle while under the influence;

 

Open container law is for both driver and passengers.  Zero tolerance law must have BAC Level of .02 for those age 21.  'Per Se' BAC Level is .08.
Enhanced penalty can be given if BAC Level is .18, driving over a certain speed, having minors in the car, refusing to take a breath, blood or urine test, having a traffic accident, or having prior convictions.  Implied consent law requires you to submit to a breath, blood or urine sample if suspected of DUI. License Suspension 1st Offense: 90 days,  License Suspension 2nd Offense: 6 months and your vehicle may be seized.  The impoundment may be temporarily or permanently.
License Suspension 3rd Offense: 6 months. 
Mandatory Alcohol Education/Assessment/Treatment is provided in the state of New York. Penalties and fines for drunk driving convictions can be reduced if the driver participates in an education and assessment program. In some states, participation is mandatory in order to restore driving privileges.  These programs include drunk driving prevention education and an assessment of the offender's drinking level. If the evaluation finds that the driver is alcohol dependent, the driver can be mandated to participate in some form of treatment. In New York
possible ignition interlock may be issued, a machine connected to car's ignition that checks for the presence of alcohol in the driver. The driver must blow into the machine to start the car and continue to periodically blow into the device to keep the car in motion. If the device senses alcohol, the car will not start or will turn itself off.  The state of New York  will allow limited driving privileges to be restored to drivers convicted of drunk driving even while their driver's license is suspended or revoked. Drivers usually must demonstrate special hardship, such as being the sole support of their families, to justify restoring privileges during suspension. Privileges often are limited such as driving only to work and back.
