Below are highlights of New Mexico law on Drinking and Driving;

 In New Mexico for 1st offense your license is suspended for 90 days.  For 2nd Offense it varies with possible ignition interlock and mandatory jail time.  It will vary with 3rd offense.  There is an open container law for both driver and passenger. Mandatory Alcohol Education and Assessment /Treatment is issued when facing a DUI charge.  Participating in these programs will reduce your fine and penalties and is mandatory in order to restore driving rights.  After 30 days hardship license can be approved while still under suspended license.  Limited driving privileges such as driving only to and from work.  Zero tolerance law for people age 21 and younger must have no more than a blood alcohol level of .02 and everyone else blood alcohol level must not be more than .08.  If found with a blood alcohol content of .16 then that is grounds for an enhanced penalty, other factors that apply are having minors in the car, speeding , having a traffic accident, refusal to take a blood, breath, or urine sample and previous convictions.  There is an implied consent law that if you are suspected of DUI you are required to submit to a breath, blood or urine sample and if you refuse penalty such as license suspension can be the result.
