Here are highlights from New Jersey law on driving while intoxicated;

  In the state of New Jersey the 'Per Se' BAC Level is .08 and for anyone age 21 and younger must have a blood alcohol level of .01 under the zero tolerance law.  There is an implied consent law that requires drivers to submit to a breath, blood or urine sample if suspected of DUI.  There is an open container law that requires both driver and passengers not to have open alcohol containers in the car.  When facing penalties for DUI you may face possible ignition interlock, a machine that is installed to your ignition that detects the sense of alcohol on the driver.  The driver must blow into the device in order to start and keep the car in motion.  You will also be responsible for the cost of the installation and maintenance of the machine.  Mandatory alcohol education and mandatory assessment of the offender’s drinking level is done and if dependent on alcohol then treatment is to be followed.  After second offense mandatory jail time and 2 years license suspension is issued.  For first offense your license is suspended for 3 months and for the third offense is for 10 years.
