'Per Se' Blood Alcohol Content Level: .08
Zero Tolerance BAC Level in Nevada: .02, it is illegal for persons under age 21 to drive with any amount of alcohol in their system. This laws penalize persons under 21 for operating a vehicle with a BAC of .00 (if the arresting officer detects the smell of alcohol) or with negligible BAC levels such as .01 or .02 percent.
Enhanced Penalty BAC Level in Nevada: .18, penalties for drunk driving are increased depending on several other factors such as, driving over a certain speed, having minors in the car, refusing to take a chemical test, having a traffic accident, or having prior convictions.
Implied Consent Law: Yes, Nevada now has passed this law that require vehicle drivers to submit to a chemical test - breath, blood or urine testing, if they are suspected of DUI. If the driver refuses to submit to the test, implied consent laws carry penalties such as mandatory suspension of a driver's license. Some believe that implied consent laws violate a driver's Fifth Amendment right against self-incrimination, but thus far those laws have been maintained when challenged in the courts.
