In the State of Nebraska no one is to have an open alcohol container in the vehicle. The Zero Tolerance Law is for anyone under the age of 21 years must have a BAC Level of no more than .02. 'Per Se' Blood Alcohol Content Level is .08. An Enhanced Penalty is given to those with a BAC Level of .15 and other factors such as having a traffic accident, speeding, having minors in the car, previous convictions and refusing to take a breath, blood, or urine sample. Under the Implied Consent Law if you are suspected of driving under the influence you are required to take a breath, blood, or urine test and if you refuse, mandatory suspension of license can be issued. You may face possible ignition interlock, a machine that you would be responsible for the cost of the installation and maintenance of the interlock device. The device checks for the presence of alcohol in the driver. The driver must blow into the machine to start the car and continue to periodically blow into the device to keep the car in motion. If the device senses alcohol, the car will not start or will turn itself off. Mandatory jail time is given after your second offense. License Suspension for 90 days for first offense, second and third offense is for one year. While under suspension after 30 days you can apply for hardship license, to which you can restore limited driving privileges while still under suspension.
