Here are highlights from Montana law on driving under the influence of alcohol;

 

License Suspension 1st Offense: six months

License Suspension 2nd Offense: one year and mandatory jail time

License Suspension 3rd Offense: one year and possible vehicle confiscation, jail time

In the state of Montana if charged for DUI you could face possible ignition interlock, a machine hooked up to your engine that detects alcohol on the driver.  The driver must blow into the machine in order to start and continually drive the vehicle.  You will be responsible for the cost and maintenance of the machine.  Mandatory alcohol education on drinking and driving and an assessment on the driver’s drinking will be assessed and if found dependent on alcohol then treatment would be mandated.  In Montana there is an open container law for both passengers and the driver.  If suspected of a DUI under the implied consent law you are required to take a breath, blood or urine test and if you refuse your license can be suspended.  Everyone must have no more than a blood alcohol content of .08.  People under the age of 21 years must not have any more than a BAC level of .02, under the zero tolerance law.  Those with a blood alcohol level of .18 can result in an enhanced penalty as well as driving with minors in the vehicle while under the influence, having a traffic accident, speeding and previous convictions.
