Here are highlights from Massachusetts law on driving while under the influence;

'Per Se' BAC Level is .08

Zero Tolerance BAC Level is .02 for those under the age of 21 years old.

Enhanced Penalty is given to those with a BAC Level: .20 and factors such as previous convictions, speeding, traffic accident, driving with minors and refusal of taking a breath, blood or urine sample

Implied Consent Law in Massachusetts gives the police the right to ask you to take a breath, blood, or urine sample if suspected of drinking and driving.

License Suspension 1st Offense: one year

License Suspension 2nd Offense: two years and also mandatory jail time is given after 2nd offense

License Suspension 3rd Offense: eight years

Mandatory Alcohol Education/Assessment/Treatment is issued to those effected by drinking and driving in hopes to educate a driver on the dangers of DUI.  During the assessment if one is considered dependent on alcohol then treatment is given.  Participating in these programs is to restore driving privileges, and may reduce fine and/or penalties given.

The driver may be ordered to have an ignition interlock, a machine hooked up to your engine that detects alcohol in the driver.  The driver is responsible for the cost and maintenance of the machine.

The driver may also have their vehicle confiscation, seized.

Open Container Law is for driver and passenger.  Therefor no one is to have an open alcohol container in the vehicle.
