These are highlights of the main provisions of Maine law dealing with drunk driving;

Under the implied consent law in Maine if one is suspected of DUI and refuse to take a chemical test - blood, a breath or urine sample, license suspension can be the result.  Refusal of a sample can result in an enhanced penalty along with other factors such as; BAC level of .15, previous convictions, speeding, an accident or having minors in the vehicle.  People of the age of 21 fall under the zero tolerance law and must have no amount of alcohol in their system, a BAC level of .00.  Everyone else the BAC level is .08.  There is an open container law that effects both driver and passengers.  Therefore, no one is to possess an open alcohol container in the vehicle.  If charged with drinking and driving one can face their vehicle being seized and possible ignition interlock.  A machine hooked up to your engine to determine if alcohol is present in the driver.  The driver would be responsible for the cost and maintenance of the machine.  One can receive mandatory alcohol education and assessment that may follow with treatment. Participation in these programs can reduce the fine and or penalty given, and is mandatory to restore driving privileges.  In Maine a hardship license may be granted if proven hardship while under suspension, only limited driving privileges would be restored e.g. driving only to and from work.
Mandatory jail time is given after 2nd offense.  License suspension for 90 days, 2nd offense: 18months and 3rd offense: 4 years license suspension.
