In Louisiana both driver and passengers is to have an open container in the vehicle under the open container law.  'Per Se' BAC Level is .08, zero tolerance law is for those under the age of 21 and must have no more than a BAC lever of .02.  An enhanced penalty is given to driver’s with a BAC level of .15, if you refuse to take a breath, blood or urine sample,  previous convictions, speeding, traffic accident, or had minors in the car.  Under the implied consent law in Louisiana if you are suspected of DUI and asked to take a sample and refused you can face a 1 year license suspension.  1st offense is 90 days license suspension but under the hardship license while license is suspended law after 30 days, you can apply to restore limited driving privileges if proven a hardship case, for example being the sole provider of your family and driving only back and forth to work.  You may encounter mandatory assessment of your drinking and if found dependent on alcohol then treatment my be ordered.  Participating in such program may reduce your penalty or fine and will help restore your diving privileges.  2nd offense is license suspension for 1 year with mandatory jail time and possible ignition interlock.  I machine that you are responsible for the cost and maintenance.  The machine is hooked up to your engine that detects alcohol in the driver.  You must blow into the machine periodically in order to start and keep driving. 3rd offense is license suspension for 2 years and your car can be seized.  Mandatory assessment/ treatment if needed and hardship license after 30 days is also applied to your 2nd and 3rd offense along with mandatory jail time.
