Below are highlights of the main provisions of Indiana law pertaining to drunk driving. Other factors can increase the penalties for drunk driving, such as if an injury or death occurred, or if a child was endangered.

'Per Se' Blood Alcohol Content Level: .08

Zero Tolerance BAC Level: .02 everyone under the age of 21 is under this law.

Enhanced Penalty for BAC Level of .15 as well as driving under the influence while minors are in the car, speeding or traffic accident, previous convictions and refusing to take a breath, blood or urine sample. There is an Implied Consent Law were if suspected of DUI and asked to take a sample and one refuses, suspension of license can be carried out.

Your 1st Offense results in 180 days license suspension.  2nd Offense: 180 days license suspension with mandatory jail time.  3rd Offense is 180 days, mandatory jail time. 

 

 Possible Ignition Interlock can be given and possible vehicle confiscation.  After 30 days you can apply for hardship license while your license is suspended.

Open Container Law in Indiana is for driver and passenger, no one is to have an open alcohol container in the vehicle.
