Here are highlights from Illinois law on driving while intoxicated.

'Per Se' BAC Level is .08

There is an Open Container Law for both passengers and driver.  No one is to have or be drinking from an open alcohol container both in a vehicle or in public.

Zero Tolerance BAC Level is .00 anyone under the age of 21 years of age must have no amount of alcohol in their system.

Enhanced Penalty BAC Level is .20 other factors such as traffic accident, speeding, previous convictions, having minors in the car, or refusing to take a breath, blood or urine sample can result in double the fine or penalty under this law.  Under the Implied Consent Law in the State of Illinois if suspected of driving under the influence and refuse to provide a sample drivers license suspension can be issued.

After 1st Offense a 90 days license suspension, 2nd Offense: 1 year license suspension with and mandatory jail time and Possible Ignition Interlock-  The 3rd Offense: Varied penalties and possible vehicle confiscation.

Mandatory Assessment/Treatment is given in order to restore driving privileges and also can reduce penalties or fines for drunk driving convictions.  An assessment on the driver to evaluate alcohol dependency, and if found counsiling, support group or treatment may be mandated

Hardship License while license suspended: After 30 days if one can prove hardshipm limited use of driving privileges can be restored while under suspension.
