Here are highlights from Florida law on drunk driving.

'Per Se' BAC Level is .08. Zero Tolerance BAC Level is .02, the zero tolerance law penalize persons under 21 for operating a vehicle with a BAC of .00 (if the arresting officer detects the smell of alcohol) or with negligible BAC levels such as .01 or .02 percent.

Enhanced Penalty is given with persons with a BAC Level of .20 however having previous convictions or driving with minors in the vehicle and such are other factors that can result in an increase penalty under this law.

Implied Consent Law allows the officer to issue a chemical test - blood, breath or urine if suspected of DUI.  Suspension for 1 year can be a result if one refuses.

License Suspension 1st Offense: 6 months
License Suspension 2nd Offense: 1 Year and mandatory jail time after 2nd offense
License Suspension 3rd Offense: 2 Years

Mandatory Alcohol Education, Assessment/Treatment is done as a result to restore driving privileges and reduce penalty.  Treatment can be issued if one is found to be dependent on alcohol.
Possible Vehicle Confiscation - car seized and ignition interlock - device that connects to your vehicle that detect alcohol.
Hardship License while license suspended after 30 days, allows you to be restored some driving privileges while under suspension, only if qualified.
There is an open container Law in Florida for driver and passenger - no alcohol can be open in vehicle.
