Here is Delaware’s Drunk Driving Laws;

Delaware’s Per Se’ blood alcohol content Level is .08.  There is a Zero Tolerance BAC Level of  .02.  An enhanced penalty occurs when the driver’s BAC level is .16 or greater and there is an implied consent law.

Delaware has a three-month licence suspension for the first offence.  The second offense results in a licence suspension of one year, and mandatory jail time also occurs after the second offense.  After the third offense a licence suspension of eighteen months and mandatory jail time can be issued.

Delaware also forces drunk driving offenders to enroll in Mandatory Alcohol Education/ treatment, as well as a mandatory assessment and if finding of alcohol dependency is needed a treatment program can be given. 
The result in a conviction may also necessitate a possible ignition interlock.  A machine that connects to your vehicle that detect alcohol. The offender is responsible for the cost of installation and maintenance.  The driver must blow into the machine to start the car and continue to periodically blow into the device to keep the car running. If the machine senses alcohol, the car will not start or will turn itself off.
