Here are highlights on Alabama law regarding driving while under influence of alcohol, controlled substances;

Zero Tolerance BAC Law - it is illegal for persons under the age of 21 drive with any alcohol in their system. 

‘Per Se’ BAC Lever .08

In most states if you are suspected of DUI, implied consent law takes place and if the person refuses to summit to a breath, blood or urine testing the outcome can result in mandatory suspension of drivers license.

When challenged in courts with the believe it violates your Fifth Amendment right against self incrimination, so far implied consent laws have been upheld.

1st Offense is license suspension for 90 Days.  2nd Offense is license suspension for 1 year, 3rd Offense is 3 years.   Repeat drunk driving offenders, most state sentences must include some jail time. Mandatory jail time for the first DUI offense in some states.  Mandatory alcohol education in many states the fines and penalties for DUI convictions can be reduced if one participates in an education and assessment program.  During these programs if an assessment of the offender finds the driver to be alcohol dependent the would have to participate in treatment, counseling or support group.
